Introduction

These Terms of Service (“Terms”) govern your use of The After Collective's AI-powered disaster recovery support services. By using our services, you agree to be bound by these Terms.

Service Description

The After Collective provides AI-powered psychological first aid and logistical support for disaster survivors. Our services include:

  • 24/7 AI support and recovery guidance
  • Connection to relevant resources and services
  • Community integration and peer support
  • Research and development of disaster recovery tools

Acceptance of Terms

By accessing or using our services, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you must not use our services.

Eligibility

Our services are intended for disaster survivors and their support networks. You must be at least 13 years old to use our services. If you are under 18, you must have parental or guardian consent.

User Responsibilities

When using our services, you agree to:

  • Provide accurate and truthful information
  • Use the services for their intended purpose
  • Respect the privacy and rights of other users
  • Not attempt to circumvent security measures
  • Not use the services for harmful or illegal purposes
  • Report any security concerns or inappropriate content

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Disaster Recovery Coach — Messaging Program

These terms apply to the Disaster Recovery Coach messaging program (the “Program”) operated by The After Collective. By providing your mobile phone number and opting in—or by messaging us on WhatsApp—you agree to receive automated and non-automated messages about disaster recovery support, service updates, and responses to your messages through the Program.

Channels

The Program may reach you via SMS/text message and/or WhatsApp, depending on how you choose to connect.

Consent

You represent that you are the subscriber or authorized user of the mobile number you provide (including the number linked to your WhatsApp account) and that you have authority to consent to receive Program messages at that number.

Message frequency

Message frequency varies and depends on your interaction with the Program. When you initiate conversations or engage actively, you may receive multiple messages in connection with your support session. If you are not actively interacting, you may receive outbound reminders or check-ins at most approximately once per week.

Charges

Message and data rates may apply to SMS and mobile data. You are responsible for any charges from your wireless carrier. WhatsApp use may consume mobile data per your plan.

Opt-out (SMS)

Reply STOP to any SMS to cancel Program SMS messages. Reply HELP for assistance.

Opt-out (WhatsApp)

Stop WhatsApp messages by replying STOP where supported, blocking our WhatsApp business number in the app, or contacting legal@theaftercollective.org.

Not emergency services

Program messaging is not a substitute for 911 or other emergency services. In an emergency, call your local emergency number immediately.

Service limitations

SMS delivery is subject to your carrier and network; we are not responsible for delayed or undelivered SMS. WhatsApp delivery depends on the WhatsApp platform and your device connectivity.

Security (SMS)

You acknowledge that SMS is not an end-to-end encrypted channel. Do not use SMS for information you would not want transmitted over standard text messaging infrastructure.

Privacy

Our collection and use of information, including mobile numbers, is described in our Privacy Policy (Disaster Recovery Coach — Messaging section), including our commitment not to sell or share mobile numbers for third-party marketing.

Intellectual Property

The After Collective retains all rights, title, and interest in and to our services, including all intellectual property rights. You may not copy, modify, distribute, or create derivative works without our express written consent.

Disclaimers

Not a Substitute for Professional Care: Our AI support is not a substitute for professional medical, mental health, or emergency services. In case of emergency, please contact emergency services immediately.

Service Availability: We strive to provide reliable services but cannot guarantee uninterrupted availability. We may modify, suspend, or discontinue services at any time.

AI Limitations: While our AI system is designed to provide helpful support, it may not always provide accurate or complete information. Users should exercise their own judgment and seek professional help when needed.

Limitation of Liability

To the maximum extent permitted by law, The After Collective shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use.

Indemnification

You agree to indemnify and hold harmless The After Collective from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

Modifications to Terms

We may modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website. Your continued use of our services after such changes constitutes acceptance of the modified Terms.

Termination

We may terminate or suspend your access to our services at any time, with or without cause, with or without notice. You may also stop using our services at any time.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or your use of our services shall be resolved through good faith negotiations. If such negotiations fail, disputes may be resolved through appropriate legal channels.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
